FREEDOM BAY CRUISES

TERMS and CONDITIONS of CHARTER
 

BOOKINGS:

Bookings are considered tentative until receipt of a completed booking form including the $100.00 per hour booked, non refundable, non transferable deposit. The deposit will be included in the total cost of the charter.

PAYMENT:

The vessel charter payment is to be made in full prior to vessel departure. Invoicing in advance can be arranged

CANCELLATION:

If the function is cancelled by the hirer, the deposit and catering charges will not be refunded. If it is necessary for Freedom Bay Cruises to cancel the function, we will attempt to find an alternative date. If no alternative date is available all money paid will be refunded within seven (7) days.

18th BIRTHDAYS:

A $500 bond will apply to 18th birthday parties. There is to be a minimum of 1 (one) supervising parent per 10 (ten) guests. An initial 2 (two) hour time limit will apply to 18th birthday parties. Extensions to this limit may be negotiated during the charter.

LIABILITY:

The charterer is responsible for the orderly conduct and safety of the patrons and must maintain the vessel in a safe condition for the duration of the charter.

BUCKS PARTIES:

A $250 bond will apply to “Bucks” parties. An initial 2 (two) hour time limit will apply to “Bucks” parties. Extensions to this limit may be negotiated during the charter.

INSURANCE:

The charter includes Public Liability Insurance cover for $10 million.

CHILDREN:

The charterer is responsible for the safety and welfare of all children. Freedom Bay Cruises accepts no responsibility for the supervision of any child.

INDEMNITY:

The charterer agrees to indemnify and keep indemnified and to hold harmless Freedom Bay Cruises, its servants and agents and each of them from and against all actions, costs, claims, charges, expenses and damages whatsoever, which may be bought or made or claimed against it by any of them arising out of or in any way related to the granting of this charter and/or the use of the vessel.

 

Freedom Bay Cruises is not responsible for any theft, loss, damage or injury suffered by the charterer or any guest or invitee of the charterer, or any person coming on the vessel during the period of charter, and the charterer indemnifies Freedom Bay Cruises in respect of all claims for loss, damage or injury caused by any person or property during the period of charter, or as a result of the use by the charterer of the vessel.

SETTING UP & PACKING UP:

The charterer has the responsibility for setting up and clearing away all equipment, decorations and signage brought onto the vessel, unless prior arrangements have been made with Freedom Bay Cruises.

 

DECORATIONS AND SIGNAGE:

No notice, sign advertisement, fittings or decorations of any kind shall be erected on the vessel or attached or affixed to the walls, doors or any other portion of the vessel without prior consent of Freedom Bay Cruises.

 

SMOKING:

Smoking is NOT PERMITTED within the enclosed or semi enclosed areas of the vessel. Smoking is permitted ONLY on the foredeck and the boarding platform aft where ashtrays are provided.

 

EMERGENCY EXITS:

All Emergency Exits and passageways are to remain unobstructed at ALL times.

TOILETS:

Notices within the toilets are to be complied with at ALL times.

DAMAGE:

The vessel or any equipment, fittings or furniture shall not be damaged. The charterer will take steps to ensure their patrons will not cause damage, loss or defacement. Any cost incurred by Freedom Bay Cruises in repairing damage, loss or defacement to the vessel or any equipment, fittings or furniture resulting from the condition in which the charterer left the vessel shall be recoverable from the charterer.

CLEANING:

The charterer is responsible for leaving the vessel in a clean tidy state. Any cost incurred by Freedom Bay Cruises in cleaning the vessel resulting from the condition in which the charterer left the vessel shall be recoverable from the charterer.

Freedom Bay Cruises reserves the right to refuse access to the vessel for any person who, in the opinion of Freedom Bay Cruises staff, is intoxicated and may cause risk to themselves, other passengers or Freedom Bay Cruises staff.

BREACHES:

Freedom Bay Cruises reserves the right to return any patron(s) to the jetty or to terminate the function due to ANY breach of condition of charter and/or patron misconduct. No refunds will be negotiated.
